The association is responsible for regulating forest professionals in BC. We ensure forest professionals are practising competently and conducting themselves in a professional manner. A complaint can be filed against any member of the association.

Complaints Resolution Process

Ensures our members are held accountable for their professional competence and conduct. In the process:
  • The registrar and director of act compliance reviews each complaint to make sure it meets the requirements for a complaint set out in the Foresters Act.
  • If the complaint is accepted, it is forwarded to the complaints resolution committee which then selects the appropriate dispute resolution mechanism to resolve the complaint. Appropriate complaint resolution mechanisms include:
    • negotiating a settlement between the parties
    • accepting admissions from a member
    • mediation
    • arbitration
    • fact finding
    • investigation
    • disciplinary hearings
  • Penalties and costs may be imposed if it is determined that the subject member has incompetently engaged in the practice of professional forestry; engaged in conduct unbecoming a member; or contravened the Foresters Act, the ABCFP bylaws, or resolutions passed by council. These can be any combination of the following:
    • Reprimands
    • Placing conditions on the member's enrolment, registration or special permit
    • Temporary suspension of the member's enrolment, registration or special permit
    • Rescinding the member's enrolment, registration or special permit
    • Requiring the member to complete a remedial program to the satisfaction of the council or appear before a board of examiners appointed by the council and satisfy the board that the member is competent to engage in the practice of professional forestry
    • Written reasons for a determination about the conduct or competence of the member and an action taken against the member
    • Fines of up to $10,000
    • Orders for costs against the member

Who Can Lodge a Complaint?

Anyone can lodge a complaint against an ABCFP member.

Complaints generally are made by other ABCFP members or the public concerned about the competence or conduct of a member. Council also has the ability to lodge a complaint and has done so when made aware of a situation that it believed warranted referral to the complaint resolution process.

When to Lodge a Complaint Against an ABCFP Member

If You are a Member of the Public

You are encouraged to lodge a complaint any time you have serious concerns about the conduct of a forest professional that you feel demands the attention of the profession. Read the question and answer document for the public for more information.

If You are an ABCFP Member
ABCFP members are expected to make efforts to resolve professional disagreements prior to lodging a formal complaint. There are a number of ways to address professional concerns and the Complaints Resolution Process is just one of them. Other methods are described in the Non-Discipline Professional Accountability Process. If these efforts are not successful, a complaint may be appropriate. Read the question and answer document for members for more information.

Acceptable Complaints

Complaints must meet the following four conditions:
1. The complaint concerns an ABCFP member or former member.
2. Sufficient information has been provided to allow an investigation to proceed.
3. The allegations involve a breach of the Foresters Act, the ABCFP Bylaws or the resolutions of the association (including policies and guidelines).
4. The parties cannot resolve the matter on a reasonable and appropriate basis.

Unacceptable Complaints

  • We generally do not get involved in commercial disputes between members or between a member and client unless the nature of the dispute warrants scrutiny from the profession.
  • We cannot accept complaints against corporations.
  • We also do not accept complaints against individuals who are not ABCFP members -- unless they are engaged in unauthorized practise in violation of the Foresters Act.

    How to Make a Formal Complaint

    Complaints must be made in writing using the Notice of Complaint Form. We encourage you to discuss your concern with the registrar and director of act compliance, Casey Macaulay, RPF cmacaulay@abcfp.ca, before lodging a complaint to ensure that you meet all of the requirements and conditions.

    Our Policy on Commenting Publicly

    Normally we do not comment on any matter that is or may be before the complaint resolution process. This protects the integrity of the process as well as the legal interests of the parties involved. There are, however, rare occasions where the integrity of the profession and legal interests require the association to comment. Decisions to comment are governed by policy.

    Discipline Case Digests

    Case Log and Discipline Case Digests

    A log of complaints made from 1996 onwards is available below. When the status of a case is listed as "Open," it can be at any stage in the complaints resolution process.
    Discipline case digests are contained with the case log. They spell out the details of specific cases together with the final disposition. They serve to: inform and educate members as well as the public; and fulfill our duty as a self-regulating profession to demonstrate accountability. We are committed to writing a case digest for every closed case.
